User-Generated Content (UGC) Release & Terms

Overview

We enjoy all the photos, videos and stories our fans share on social media — including the content you have posted! 

These terms explain how we intend to use the content you’ve shared, and they reflect your and our agreement regarding their use on our social media channels, email newsletters and website, and in other marketing materials. In this agreement, “content” includes but is not limited to photos, graphics, images, videos, reviews, testimonials, Facebook or Instagram Reels or stories, personal stories or information about you or your pet that you have willingly shared. It does not include private or sensitive information. 

By replying to us with your agreement, you grant to Hank & Roy LLC and its affiliates, including partners and retailers, a non-exclusive, perpetual, irrevocable, transferable, sublicensable, worldwide, royalty-free license to modify, copy, reproduce, publish, add to, edit, exploit and otherwise use the image, video or statement in any form (including, without limitation, video, social media posting, reproduction, email, website, publication and distribution), for any purpose, including, without limitation, for advertising, promotional, trade, commercial or any other purposes and without further review, notice, approval, consideration or compensation. 

You represent and warrant that 1) you own any and all copyright(s) to the images, videos and statements, 2) that you have all the necessary rights or permissions to allow Hank & Roy to use the images and statements. You also agree to indemnify and hold Hank & Roy harmless from and against any third-party claims, losses, damages, liabilities, costs and expenses (including reasonable attorney’s fees) related to any breach of these representations and warranties, and 3) to the best of your knowledge, all laws and local rules and guidelines are being followed and represented in this image. 

You also hereby release and discharge Hank & Roy LLC, its employees, agents, successors, licensees and assignees from any and all claims you might have in connection with our use of the images, videos and statements, including, without limitation, any claims for copyright, trademark, defamation, violation of any moral or artist right, and/or any right of privacy or publicity. 

You grant Hank & Roy LLC and its affiliates the right to use your name, your pet’s/pets’ name(s), images, likeness(es), voice(s), photograph(s) and/or video(s) in connection with Hank & Roy LLC’s use of your images, videos or statements, without restriction as to frequency, duration, country or territory, and without further review, notice, approval, consideration or compensation, except as prohibited by law. 

This Image & Statement Use Agreement shall be governed by the laws of the State of Missouri (excluding all conflicts of laws principles that would require the application of the laws of a different state).
